Your Initial Child Custody Order

If you and your former partner already agree on child custody, or you will be able to negotiate an agreement, it is far more likely that the result will be a good fit for your family. Whenever possible, we help our clients achieve negotiated custody agreements.

If you cannot agree, we can help you bring your case before a judge in Nevada family court who will consider factors such as:

  • The nature of the relationships between the children and each parent
  • Which parent is most likely to foster a meaningful relationship between the children and the other parent, if given primary custody
  • The level of conflict between the divorcing couple, and whether one parent is primarily the initiator of the conflict
  • Whether the parents can cooperate to meet the needs of the children and whether one parent is not cooperating
  • Whether there has been domestic violence in the relationship

What is Joint Custody? 

The Nevada Supreme Court has refined the meaning of joint custody. Joint custody used to mean that each parent had the child 50 percent of the time. It now means that both parents have "meaningful contact" with the children, which can mean a division of parenting time other than 50/50. This will affect the calculation of your child support, and may affect pre-existing child custody orders.

Modification of Child Custody Orders

As children grow and family situations change, it is often necessary to modify an existing child custody order. We help clients seek changes to primary custody and visitation schedules, when necessary. We also help when one parent wishes to move away with the children, whether that parent has joint custody or primary custody.
