Las Vegas Contested Divorce Lawyers

A contested divorce will take place whenever there is a dispute over any area of a divorce proceeding. It does not matter how small the dispute is; if the two parties do not agree on one term, the divorce is contested. If the parties agree on everything, they can file for the cheaper and quicker uncontested divorce.

In a contested divorce, the process typically goes as follows:

a. A complaint is filed, and the other party has 20 days to respond with an answer to the complaint.

b. There is an early case conference. This is a meeting where the parties agree to the main case deadlines.

c. Attorneys file a joint case conference report.

d. Discovery begins. Depending on the complexity of the case, this part of the process could take several months to complete.

e. If children are involved, a child custody evaluation may take place, where a recommendation is given to the court.

f. Temporary orders for custody, child support, visitation, attorney's fees, spousal support and exclusive possession of marital residence are typically established during this process.

g. If the parties are able to come to an agreement on the issues of the divorce (child custody, child support, visitation, attorney’s fees, spousal support, etc.), the matter is resolved and a decree will be entered by the court, reflecting the agreement of the parties.

h. If the parties cannot resolve their issues, there will be a trial. At the end of the trial, the court will enter a divorce decree, which will detail the terms of the divorce.
